Terms of Service

These Terms of Service govern your use of Divotery, an online marketplace that connects golf players with independent coaches for in-person lessons. Please read them carefully. By creating an account or booking a lesson, you accept these terms.

1. Who we are

Divotery operates an online marketplace at divotery.com, app.divotery.com and coach.divotery.com, where players find golf coaches, book lessons and pay online.

In these terms, "Divotery", "we" and "us" mean the operator of that platform, and "you" means the person using it. Divotery is operated from Denmark.

You can reach us at support@divotery.com. We answer in Danish and English.

2. Our role, and what we are not

Divotery is an intermediary. We provide the platform, take payment, hold the money until a lesson is completed, and pay the coach.

We do not teach. The lesson itself is an agreement between you and the coach. Coaches are independent professionals. They are not our employees, agents or subcontractors, and we do not control how they teach, what they say, or the venue they use.

We review coaches before their lessons go live and may show a badge such as "certified". That review is a basic check of the information a coach gives us. It is not a guarantee of their skill, their safety record or the result of any lesson.

3. Eligibility and your account

To hold an account you must be at least 18 years old and able to enter a binding agreement where you live.

You agree to:

  • give accurate information and keep it up to date;
  • keep your password private, and your booking confirmation codes private until a lesson is done;
  • take responsibility for everything done through your account.

Lessons for a child must be booked by a parent or guardian, who accepts these terms on the child's behalf and stays responsible for the booking.

4. Booking a lesson

Coaches publish lessons with a price, a duration and the times they are available. When you pick a time and pay, that time is reserved for you and you get a confirmation by email.

A booking is only confirmed once payment succeeds. Until then, someone else can still take the time.

Group sessions are booked per person. A course books every session in the series at once.

5. Prices and payment

Coaches set their own prices. The price you see is the price you pay, and players pay no booking fee.

You are charged in the coach's currency. If we show a converted amount anywhere, it is for reference only, and your bank may apply its own exchange rate or fees.

Payment is taken in full when you book, through our payment provider Stripe. Your full card number never reaches us.

We hold the money until the lesson is completed and confirmed, and only then pay the coach.

6. Confirming a lesson took place

Each one-to-one booking has a 4-digit code. After the lesson, you give the code to the coach, who enters it to confirm the lesson happened. That releases the payment.

Only give the code once the lesson has actually taken place. It is your confirmation that the coach delivered it.

If the coach does not confirm with your code within 36 hours after the lesson was due to end, the booking is refunded to you automatically and in full.

Group sessions do not use codes. The coach manages attendance.

7. Cancellations, refunds and no-shows

You can cancel a lesson free of charge up to 36 hours before it starts, and get a full refund to the card you paid with.

  • Inside 36 hours, the booking is no longer automatically refundable. Contact us and we will look at it case by case.
  • If the coach cancels or does not turn up, you get a full refund.
  • If you do not turn up, and the coach was there and ready, the coach may treat the lesson as delivered.

Refunds go back to your original payment method and usually appear within 5 to 10 business days, depending on your bank.

8. Right of withdrawal for EU consumers

Consumers in the EU normally have 14 days to withdraw from a contract made online.

That right does not apply to services connected with leisure activities where the contract sets a specific date or period of performance. A golf lesson booked for a specific time is such a service, so the 14-day withdrawal right does not apply to it. This follows article 16(l) of the Consumer Rights Directive, implemented in Denmark in the Danish Consumer Contracts Act (forbrugeraftaleloven).

This does not reduce the cancellation rights we give you in section 7, or your statutory rights if a service is not delivered as agreed.

9. Commission and coach payouts

Divotery charges coaches a commission on the lesson price. Players pay nothing extra.

Your commission rate is determined solely by the number of lessons you have delivered through Divotery, and the same rate applies to every booking regardless of which player makes it: 15% below 100 delivered lessons, 12.5% from 100, 10% from 200 and 7.5% from 300.

New coaches receive a launch offer: 0% commission on their first 50 delivered lessons, with no time limit. Lessons delivered under the launch offer count toward the tiers above.

The rate applying to a booking is fixed at the moment the booking is created and does not change afterwards, including if you reach a better tier in the meantime. Your current rate and your progress toward the next tier are shown in your dashboard. We may agree an individual rate with you in writing, which then replaces the rates set out above. We may change these rates for future bookings by giving you reasonable notice.

Payouts run through Stripe Connect. Before your lessons can go live you must complete Stripe's identity and bank verification and accept the Stripe Connected Account Agreement.

Coaches are responsible for their own income tax, VAT and any reporting where they operate. We are not your employer and we do not withhold tax for you.

10. Coach obligations

If you offer lessons on Divotery, you confirm that you:

  • hold the qualifications, licences and permissions needed to coach where you teach;
  • hold any insurance required for your activity;
  • have the right to teach at the venue you list, and state clearly in the listing if the player needs their own green fee, range balls or club access;
  • describe your lessons honestly, keep your availability current, and turn up on time;
  • treat players with respect and follow the safety rules of the venue.

You set your own prices, hours and teaching method. Nothing in these terms creates employment, partnership or agency between us.

11. Player obligations

When you book, you agree to turn up on time and ready, follow the coach's safety instructions and the rules of the venue, and tell the coach about any injury, medical condition or limitation that affects your ability to take part.

Green fees, range balls, equipment hire and club access are not included in the lesson price unless the coach says so in the listing.

12. Reviews

After a completed lesson you can review your coach. A review must be your own honest, first-hand experience of a lesson you actually booked and attended. Your first name is shown publicly with it.

We may remove a review or other content that is untrue, abusive, discriminatory, unlawful, exposes someone else's personal data, or is posted to manipulate ratings.

Coaches must not offer anything in return for a review, or pressure a player to change or remove one.

You keep ownership of what you post, and you give us a non-exclusive, worldwide, royalty-free licence to host and display it on the platform while it is published.

13. Messaging

Divotery includes messaging so players and coaches can sort out practical details. Keep it relevant and respectful.

Do not use it to move a booking off the platform to avoid commission, to send marketing or spam, or to exchange payment details.

We do not routinely read messages. We may access them where we need to investigate a report of abuse, fraud or a safety concern, or where the law requires it.

14. Acceptable use

You agree not to:

  • use Divotery for anything unlawful, or to harass, threaten or discriminate against anyone;
  • take a booking that began on Divotery off the platform in order to avoid commission;
  • create fake accounts, listings, bookings or reviews, or use someone else's identity;
  • scrape, copy or resell platform data, or try to break, overload or reverse engineer the service;
  • upload malware, or anything you do not have the right to upload.

15. Suspension and closing your account

You can close your account at any time from your profile, or by asking us.

We may suspend or close an account that breaches these terms, where the law requires it, or where we reasonably suspect fraud or a risk to other users.

If we close an account while bookings are outstanding, players are refunded for lessons not yet delivered and coaches are paid for lessons already delivered.

Closing an account does not delete records we are required to keep for accounting and legal reasons. See the Privacy Policy.

16. Availability of the service

We work to keep Divotery running, but we do not promise it will be uninterrupted or free of errors. We may change, suspend or withdraw parts of the service, and we will give reasonable notice of significant changes where we can.

17. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or your rights as a consumer under mandatory law.

We provide the platform. We are not a party to the lesson, and we are not liable for what happens during it, including injury, loss or damage caused by a coach or a player, or for the quality or the result of any coaching.

We are not liable for indirect or consequential loss, or for loss of profit, opportunity or data.

Where we are liable in connection with a booking, our liability is limited to the amount you paid for that booking.

Coaches are responsible for claims arising out of their own lessons, and agree to cover us for losses we suffer because they broke these terms or the law.

18. Complaints and disputes

Contact support@divotery.com first. Most issues are quicker to fix directly, and we aim to reply within a few working days.

If we cannot agree, consumers in Denmark can take a complaint to Center for Klageløsning at Nævnenes Hus (naevneneshus.dk). Consumers elsewhere in the EU can contact their national alternative dispute resolution body or their European Consumer Centre.

These terms are governed by Danish law, and disputes belong before the Danish courts. If you are a consumer, this does not take away the protection of mandatory law in your country of residence, or your right to bring a case there.

19. Changes to these terms

We may update these terms. Where a change materially affects you, we will tell you by email or in the app before it takes effect.

A booking is governed by the terms that applied when you made it. If you keep using Divotery after a change takes effect, you accept the updated terms.
